California: Bill Filed to Harass Firearm Industry With Lawsuits
On Monday, the California Legislature opened and went right to work on pushing their gun control agenda. Assembly Member Phil Ting (D-19) introduced Assembly Bill 1594, to allow civil lawsuits against the firearm industry under vague conditions.
Assembly Bill 1594 declares that a firearm industry member “shall have created or maintained a public nuisance… if their failure to follow federal, state, or local law caused injury or death or if the gun industry member engaged in unfair business practices.”
Existing federal and state laws already heavily regulate the firearm industry and the laws allow for stiff penalties for violations. This is the latest salvo in gun control advocates’ long-running effort to circumvent the federal Protection of Lawful Commerce in Arms Act (PLCAA), which ensures Americans have reasonable access to firearms. The PLCAA does not prohibit lawsuits against the firearm industry for knowingly unlawful sales, for negligent entrustment, and on traditional products liability grounds.
