NJ Unconstitutionally Bans Guns That Hold More Than 10 Rounds – Makes Citizens Criminals If They Don’t Turn Them In

A state that has some very unconstitutional, strict gun laws which have even cost people their lives, has passed pretended legislation that will give their citizens 180 days to turn in all their guns and magazines that hold more than 10 rounds or become criminals.  Talk about ex post facto laws!  Talk about unconstitutional!

First, the state of New Jersey does not acknowledge the words of the Second Amendment, which they are also to uphold, which acknowledges that the right to keep and bear arms shall not be infringed.  Notice the term is a “right,” not permission.  Therefore, that right cannot be legislated by any government of man.

Yet, this is exactly what the Communist-minded legislature and governor are clearly violating.

They are also in violation of the US Constitution not only on the issue of the Second Amendment but also on the issue of ex post facto laws.

No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility. -Article 1, Section 10, Clause 1

Sorry, everyone that voted for this legislation, as well as the governor have now become criminals under our Constitution and should be treated as such.  They should be viewed as enemies of the people of New Jersey and enemies of the US, but sadly, people will wave their hands and just give them a pass.  After all, they’re just infringing on your rights, right?

Assembly Bill 2761 gives citizens 180 days to surrender all firearms and magazines that hold more than 10 rounds.  If you fail to do so, you will be treated like the criminals you arm yourself against.

According to the legislation, the bill is to reduce “maximum capacity of ammunition magazines to 10 rounds.  New Jersey citizens, you have 180 days to determine whether you will follow these criminals or follow the true law.

“A person who legally owns a semi-automatic rifle with a fixed magazine capacity exceeding 10 rounds or a large capacity ammunition magazine… which is capable of holding more than 10 rounds of ammunition… may retain possession of that rifle or magazine for a period not to exceed 180 days after the effective date of this act.”

So, how are you to comply with this pretended legislation?  According to the bill:

  • Transfer the semi-automatic rifle or magazine to any person or firm lawfully entitled to own or possess that firearm or magazine;
  • Render the semi-automatic rifle or magazine inoperable or permanently modify a large capacity ammunition magazine to accept 10 rounds or less;
  • Voluntarily surrender the semi-automatic rifle or magazine

Oh and just so you aren’t shot and killed by a New Jersey policeman should you choose to be a good little slave and comply with unlawful “laws,” the bill states that you must give a written notice that includes “the proposed date and time of surrender” and they must be surrendered to the superintendent or the chief of police in the municipality where you live.

However, some people are just not going to sit back and take it.  Nope, according to The Washington Free Beacon, the Association of New Jersey Rifle & Pistol Clubs has already filed a motion to block any enforcement of the unlawful legislation in the US District Court of New Jersey.

“It turns one million people into criminals with the stroke of a pen, limits self-defense, and takes away property lawfully acquired. Buy it yesterday, ban it today, go to prison tomorrow—it’s the Jersey way, and the goal of our lawsuit is to boot this law, which makes no one safer, into the trash heap of history where it belongs,” said Scott Bach, the group’s executive director.

So, what are these tyrants in New Jersey threatening you with should you decide to keep your lawfully acquired and kept property that is protected under the true law?  They will seek to charge you with a fourth-degree felony and you may face up to 18 months in jail, as well as a $10,000 fine.

Seriously, our founders would have literally been up in arms over this kind of legislative abuse.  In fact, they did just that!

The legislation comes in a long line of unconstitutional bills signed by Communist Governor Phil Murphy and comes in the wake of the town of Piscataway, led by a former Marine, pushing unlawful zoning restrictions that would eliminate the legal retail sale of guns.

As The Free Thought Project reports, this is the latest attack on your rights citizens of New Jersey.

This legislation is just one of several bills that have been passed in New Jersey recently, with the purpose of increasing gun restrictions in a state that is already known for its strict gun laws. Gov. Phil Murphy signed the bills into law earlier this month, which are all targeted at increasing gun control by expanding background checks, adding increased restrictions to concealed carry permits, and establishing a “red flag” system where individuals can report people who they believe are dangerous, and those suspects will have their firearms temporarily seized by police.

Assembly Bill 1217 authorizes “gun violence restraining orders” and firearm seizure warrants; Assembly Bill 1181 requires firearms seizure when mental health professionals determines a patient poses a threat of harm to himself or others; Assembly Bill 2757 requires background check for private gun sales; Assembly Bill 2758 codifies and restricts regulations defining justifiable need to carry handgun; and Assembly Bill 2759 prohibits possession of ammunition that qualifies as “capable of penetrating body armor.”

Yet even with the current gun regulations in place, a convicted felon who spent years in prison on aggravated manslaughter charges was able to access a handgun, which he used to unleash a hail of bullets on a crowd at an arts festival in Trenton, New Jersey, last week, and 22 people were injured as a result. Everything he did to obtain the gun and open fire was illegal—none of the laws stopped him.

Understand that these bills are pitched to you as if your representatives are doing you a favor.  They aren’t.  They are violating their oath, the law, and your rights.  They are making you vulnerable, and at the same time, they are defining you as criminals for owning property protected under our Constitution, even though you have committed no crime.

Yes, New Jersey, ex post facto laws are unconstitutional and those who advanced this bill are breaking the law.
