Ah, yes, now it’s becoming clear that even those unconstitutional gun check systems that were unlawfully imposed by Congress on law-abiding citizens aren’t even any good at stopping criminals who are hell-bent on murdering innocent people, and three US cities have filed lawsuits this week that demonstrate it.

What’s most interesting is that all three cities are big proponents of “gun control:”  New York City, San Francisco and Philadelphia.

Three large U.S. cities filed a federal lawsuit Tuesday against the Department of Defense, arguing that many service members who are disqualified from gun ownership weren’t reported to the national background check system.

New York City, San Francisco and Philadelphia said in court papers that the military’s broken system for relaying such information helped spur the massacre of 26 people inside a Texas church last month.

The lawsuit filed in federal court in Alexandria, Virginia, seeks an injunction and judicial oversight to ensure ongoing compliance with the Defense Department’s obligation to submit records.

Federal officials didn’t immediately respond to a request for comment on the accusations. Military officials previously acknowledged problems with their reporting.

The Defense Department’s failure to report “significant numbers” of disqualifying records to the FBI’s national background check system allowed former U.S. Air Force member Devin P. Kelley to buy a rifle and shoot 26 people to death Nov. 5 in a Sutherland Springs, Texas, church, the lawsuit said. Kelley had been convicted of assaulting family members in a 2012 court martial and should not have been allowed to purchase a gun.

Air Force leaders already acknowledged that the service failed to alert the FBI to Kelley’s criminal history and that they discovered “several dozen” other such reporting omissions. They said that while policies and procedures requiring reporting were in place, training and compliance measures were lacking.

And Army leaders have said their service also has similar gaps.

“This failure on behalf of the Department of Defense has led to the loss of innocent lives by putting guns in the hands of criminals and those who wish to cause immeasurable harm,” New York Mayor Bill de Blasio said in a statement. “New York City is joining Philadelphia and San Francisco to stand up to the Department of Defense and demand they comply with the law and repair their drastically flawed system.”

Actually, it was the acts of Mr. Kelley that led to the loss of innocent lives.  The fact that no church member seemed to be armed only added to the death toll and the fact that the Air Force didn’t put Kelley in the database was only a formality that would have only hindered him by minutes if not days from obtaining a weapon, legally or illegally.

We have laws against murder.  Kelley crossed that line when he began firing and murdered his first victim.

Whether his weapon was obtained legally or illegally really is irrelevant at this point.

Written law does not stop the criminally minded person from meeting their goal, acquiring a weapon and engaging in criminal activity.  It simply states where the line is crossed.

Let’s say that the Air Force did put Mr. Kelley in the database, and yet, he obtained a weapon from a black market sale or via a burglary and committed the same crime.  Why would we not simply look at this as a crime rather than an incident to be used to promote an unlawful and unconstitutional agenda against the rights of gun owners and a usurpation of the government to infringe on those rights?

Well, we wouldn’t.  The system in place is there due to “feel good” gun grabbers who act like they are doing something when they are doing nothing but engaging in crimes against the people they claim to represent.

San Francisco City Attorney Dennis Herrera said in a statement that the Department of Defense’s failure to accurately report criminal convictions puts Americans at risk.

“We cannot accept the level of gun violence in our country as ‘just the way it is,'” he said.

But that is the case until such time as we remove the infringement upon law-abiding citizens to simply keep and bear arms lawfully without restraint of government.

I challenge any city in America that has gun control laws out the wazoo to do a simple test.  Repeal each and every gun law you have on the books for one year.  Make it know they are repealed and allows law-abiding citizens to keep and bear arms wherever they go and you will see a drastic decrease in crime and murders and gun violence.
